Professional and Personal Use

Unless otherwise stated, products sold by Dall Italia may be purchased for personal use or professional salon use. Customers, salons, stylists, beauty professionals, and other purchasers are responsible for using products safely, properly, and only in accordance with product instructions, manufacturer guidance, applicable licensing requirements, and all federal, state, and local laws.

Certain products may be intended for professional use only. If you are purchasing or using products in a salon, spa, studio, or other professional environment, you are solely responsible for ensuring that you and your team are properly trained, licensed where required, and qualified to use the products.

Dall Italia, LLC is not responsible for misuse, improper application, failure to follow instructions, allergic reactions, professional technique errors, client outcomes, or use of any product outside its intended purpose.

Product Information, Ingredients, and Results

Product descriptions, ingredient information, benefits, usage recommendations, images, videos, and educational content are provided for general informational purposes only. Product information may be provided by manufacturers, brand partners, suppliers, or distributors and may be updated, changed, or corrected at any time.

Individual results may vary based on hair type, skin type, scalp condition, prior treatments, product usage, application method, frequency of use, professional technique, and other individual factors.

Nothing on this website should be interpreted as medical advice, dermatological advice, or a guarantee of specific results. Customers should review all labels, ingredients, warnings, and instructions before use. Orders, Acceptance, and Right to Refuse Service

Receipt of an order confirmation email does not constitute acceptance of your order or confirmation of an offer to sell. Dall Italia, LLC reserves the right to accept, refuse, cancel, limit, or modify any order at any time, including after an order has been submitted or confirmed.

We may refuse or cancel orders for reasons including, but not limited to, suspected fraud, unauthorized resale, incorrect pricing, product unavailability, payment issues, shipping restrictions, policy violations, abuse of promotions, or errors in product information.

If your payment method has already been charged for an order that is later canceled, we will issue a refund to the original payment method, subject to applicable processing timelines.

No Unauthorized Resale

Products purchased from Dall Italia are not authorized for resale unless you have received prior written approval from Dall Italia, LLC. Unauthorized resale, marketplace listing, diversion, relabeling, repackaging, or redistribution of products is strictly prohibited.

We reserve the right to refuse, cancel, or limit orders that we believe are intended for unauthorized resale or distribution.

Shipping, Delivery, and Delays

Dall Italia will make reasonable efforts to ship products within the timeframe communicated at checkout or in the applicable product listing. If no specific shipping timeframe is provided, we will make reasonable efforts to ship within a commercially reasonable period.

Shipping timelines are estimates and may be affected by product availability, carrier delays, weather, address issues, payment verification, supply chain interruptions, or other factors outside our control.

Once an order is transferred to a shipping carrier, delivery timing and final delivery are subject to the carrier’s processes. Dall Italia, LLC is not responsible for delays caused by carriers, incorrect shipping information provided by the customer, failed delivery attempts, stolen packages after delivery confirmation, or refusal to accept delivery.

If an item cannot be shipped or becomes unavailable, we may contact you regarding a delay, substitution, store credit, partial fulfillment, or refund, as applicable.

Returns, Cancellations, and Purchase Options

All returns, cancellations, discounted orders, promotional purchases, bundles, final sale items, subscriptions, event purchases, VIP experiences, and other purchase options are subject to the applicable policies posted on dallitalia.live.

By placing an order, you agree to the return, refund, cancellation, shipping, and purchase option policies in effect at the time of purchase.

Dall Italia, LLC reserves the right to approve or deny return or cancellation requests where allowed by law, including requests involving discounted items, promotional offers, bundles, final sale products, limited inventory, event purchases, VIP experiences, opened products, used products, broken seals, or products that cannot be resold due to quality, safety, or hygiene standards.

Subscriptions and Auto-Refill

If you enroll in a subscription, auto-refill, recurring order, or similar purchase option, you authorize Dall Italia, LLC or its payment processor to charge your selected payment method according to the frequency, price, and terms presented at checkout.

You may cancel future subscription orders through your customer account or by contacting us at ciao@dallitalia.live. To avoid being charged for the next scheduled order, cancellation must be completed before the order is processed.

Once a subscription order has been processed, packed, shipped, or prepared for fulfillment, it may no longer be eligible for cancellation and may instead be subject to our return policy.

Subscription prices, product availability, shipping costs, and applicable taxes may change over time. We reserve the right to modify or discontinue subscription options as allowed by law.

Events, VIP Experiences, and In-Person Participation

Dall Italia may offer events, networking experiences, trainings, VIP experiences, salon partner opportunities, product demonstrations, or other in-person or virtual experiences.

Participation in any event or experience is voluntary and at your own risk. Event details, speakers, products, hospitality, gifts, benefits, timing, location, and availability may be changed, substituted, limited, or canceled at Dall Italia’s discretion.

Event-related purchases, VIP experiences, product bundles, deposits, or limited-access offers may be non-refundable once confirmed, especially when products, inventory, staffing, hospitality, or event planning have been reserved on your behalf.

By attending an event, you authorize Dall Italia, LLC to photograph, film, record, or otherwise capture your name, image, likeness, voice, statements, testimonial, salon name, business name, or content created during the event, and to use that content for marketing, social media, advertising, education, promotional, and commercial purposes, unless you notify us in writing before participating.

Testimonials, Reviews, and Social Content

Customer reviews, testimonials, endorsements, before-and-after content, social media posts, event footage, salon partner content, and product feedback may reflect individual experiences and do not guarantee that every customer will have the same results.

If you receive compensation, free products, discounted products, gifts, VIP benefits, commissions, affiliate compensation, referral compensation, or any other value in connection with content you post about Dall Italia or its products, you are responsible for clearly and conspicuously disclosing that relationship in accordance with applicable advertising and endorsement laws.

Dall Italia, LLC reserves the right to use, repost, edit, share, promote, or display content you provide, tag us in, submit to us, or authorize us to capture, subject to applicable law and our Privacy Policy.

Third-Party Brands and Manufacturer Responsibility

Dall Italia is a marketplace, distributor, retailer, and/or promotional partner for select beauty, haircare, skincare, salon, and wellness products, including products manufactured by third-party brands.

Dall Italia, LLC is not the manufacturer of third-party products unless expressly stated. Product formulas, packaging, ingredients, claims, warnings, directions, availability, and performance may be determined by the applicable manufacturer or brand owner.

To the fullest extent permitted by law, claims related to manufacturing defects, formulation, product safety, ingredient changes, packaging changes, warnings, or product performance may also need to be directed to the applicable manufacturer or brand.

Nothing in this section limits any rights you may have under applicable law.

Disclaimer of Warranties

The website, products, services, content, events, and materials are provided on an “as is” and “as available” basis, unless otherwise expressly stated in writing.

To the fullest extent permitted by law, Dall Italia, LLC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.

Some jurisdictions do not allow certain warranty limitations, so some of these limitations may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, Dall Italia, LLC, its owners, officers, employees, contractors, affiliates, partners, suppliers, manufacturers, service providers, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising out of or related to your use of the website, purchase or use of products, participation in events, reliance on content, inability to access the site, delivery issues, third-party products, or third-party services.

This includes, but is not limited to, loss of profits, loss of revenue, loss of business opportunity, data loss, allergic reactions, improper product use, professional application issues, client outcomes, service interruptions, or reliance on product information.

To the fullest extent permitted by law, Dall Italia’s total liability for any claim shall not exceed the amount you paid to Dall Italia for the product or service giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Dall Italia, LLC, its owners, officers, employees, contractors, affiliates, partners, suppliers, manufacturers, service providers, and representatives from and against any claims, liabilities, damages, losses, costs, expenses, or fees, including reasonable attorneys’ fees, arising out of or related to:

• Your use or misuse of the website, products, services, or content

• Your violation of these Terms

• Your violation of any law or third-party right

• Your professional use or application of products

• Your resale or unauthorized distribution of products

• Your User Content, reviews, testimonials, or social media content

• Any claim made by your client, customer, employee, contractor, or third party related to your use of products purchased from Dall Italia

Force Majeure

Dall Italia, LLC shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to carrier delays, supply chain disruption, labor shortages, acts of God, natural disasters, weather events, pandemics, public health emergencies, government actions, war, terrorism, civil unrest, cyberattacks, power outages, platform outages, payment processor issues, manufacturer delays, or other events beyond our control.

Chargebacks and Payment Disputes

If you believe there is an issue with your order, please contact us first at ciao@dallitalia.live so we can attempt to resolve the matter.

We reserve the right to suspend or terminate accounts, refuse future orders, or pursue available remedies in cases involving fraudulent chargebacks, payment disputes, abuse of promotions, unauthorized resale, or misuse of our policies.

Governing Law and Venue

These Terms of Use and any dispute arising out of or related to your use of the website, products, services, purchases, events, or other offerings shall be governed by the laws of the State of Utah, without regard to conflict of law principles, unless another jurisdiction is required by applicable law.

Subject to the arbitration provision below, you agree that any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to personal jurisdiction and venue in those courts.

Arbitration and Class Action Waiver

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the website, products, services, purchases, events, or communications with Dall Italia shall be resolved by binding arbitration on an individual basis, rather than in court.

You and Dall Italia, LLC agree that neither party may bring claims as a plaintiff or class member in any class action, collective action, private attorney general action, or representative proceeding.

Nothing in this section prevents either party from seeking relief in small claims court where permitted, or from seeking temporary or emergency injunctive relief for intellectual property misuse, unauthorized resale, fraud, security issues, or misuse of confidential information.
